Portland Decks & Fences provides residential and light commercial outdoor construction services in Portland, TX and surrounding areas. Our services include, but are not limited to, the design and installation of decks, fences, pergolas, screened porches, covered patios, and related outdoor structures.
All services are provided subject to site conditions, permit requirements, material availability, and the specific scope agreed upon in a written contract or estimate. We reserve the right to decline any project that falls outside our service area, scope of expertise, or scheduling capacity.
Estimates provided by Portland Decks & Fences are based on the information available at the time of the site visit or consultation. An estimate is not a guaranteed final price. The final project cost may change if:
Any changes to scope or pricing will be communicated to you in writing before additional work proceeds. We will not bill you for unanticipated costs without first obtaining your approval.
Project start dates are scheduled based on contractor availability, permit timelines, and material delivery. We will give you advance notice if your scheduled start date needs to change. Weather delays and permit processing times may affect the schedule without penalty to either party.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. If materials have already been ordered specifically for your project, you may be responsible for reasonable restocking or return fees. Any deposit paid to secure materials or a project date may be non-refundable if cancellation occurs after materials have been ordered.
Portland Decks & Fences reserves the right to cancel or postpone a project if site access is not available as agreed, if payment obligations under an existing agreement have not been met, or if conditions make it unsafe or impractical to proceed.
Payment terms for each project will be specified in the written contract or invoice. Typical arrangements may include a deposit at the time of contract signing, a progress payment at a defined milestone, and a final payment upon project completion and your approval of the finished work.
Invoices not paid within the period specified in the contract may accrue a late fee as stated in that document. We reserve the right to suspend work on a project if payments are significantly overdue, without liability for delays caused by that suspension.
Accepted payment methods will be communicated at the time of contract. All prices are in U.S. dollars.
Portland Decks & Fences warrants that work will be performed in a workmanlike manner using materials agreed upon in the written contract. Specific warranty terms, including duration and coverage, will be stated in the project contract.
Warranties do not cover damage resulting from misuse, neglect, alterations made by the customer or third parties, acts of nature (including storms, flooding, or hurricane damage), or normal wear and tear over time. Material warranties, if any, are provided by the manufacturer of the materials used and are subject to those manufacturers' terms.
THE WEBSITE AND ALL INFORMATION PROVIDED THROUGH IT ARE OFFERED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by applicable law, Portland Decks & Fences shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, including but not limited to loss of profits, loss of use, or loss of data.
Our total liability for any claim arising out of or related to services provided shall not exceed the total amount paid by you to Portland Decks & Fences for the specific project giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.
Portland Decks & Fences will apply for and manage required building permits as part of the project scope, unless otherwise agreed in writing. You agree to provide reasonable access to your property for site visits, inspections, and construction activities. You are responsible for notifying us of any easements, setbacks, deed restrictions, or HOA requirements that may affect the project before work begins. We are not liable for delays or additional costs caused by undisclosed restrictions.
If a dispute arises between you and Portland Decks & Fences relating to our services or these Terms and Conditions, both parties agree to first attempt to resolve it through good-faith negotiation. If negotiation does not resolve the matter within 30 days of written notice, either party may pursue mediation as a next step before resorting to litigation.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction where necessary to prevent immediate harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising from or related to these terms shall be brought in a court of competent jurisdiction in Texas.
You may use our website for lawful purposes only. You agree not to use the site in any way that violates applicable law, infringes on the rights of others, or disrupts the operation of the site.
